Terms of Service

Welcome to KinkSim. These Terms of Service ("Terms") govern your use of the KinkSim platform available at kinksim.com ("Platform"), operated by Aphryl Labs OÜ (registry code: 17372970) ("we", "us", "our"), a company registered in the Republic of Estonia.

By accessing or using KinkSim, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old to use KinkSim. By using the Platform, you confirm that you are of legal age in your jurisdiction to view and interact with adult content. We reserve the right to request age verification at any time and to terminate accounts where we reasonably believe the user is underage.

2. Accounts

You are responsible for maintaining the security of your account and all activity that occurs under it. Each person may hold only one account. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

3. Characters & Content

3.1 Character Ownership

You create and own your characters on KinkSim. You retain rights to the character concepts, names, and descriptions you create. By creating a character on the Platform, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and use your character within the Platform for the purpose of operating the service (including AI-powered conversations and media generation).

3.2 User-Generated Content

You are responsible for all content you create, upload, or send through the Platform, including images, videos, and messages. You must have the right to use any content you upload and it must comply with our content guidelines (Section 8).

3.3 No Real People

Characters must be entirely fictional. You may not create characters that impersonate, depict, or are based on real people — living or deceased — without their explicit written consent. This includes public figures, celebrities, and private individuals. Violation of this rule will result in immediate account termination.

4. AI-Generated Content

KinkSim uses artificial intelligence to power character conversations, generate images, and generate videos. You acknowledge that:

  • AI responses are generated automatically and do not represent the views of KinkSim or any real person.
  • AI-generated content may occasionally be inaccurate, inappropriate, or inconsistent with a character's intended personality.
  • All AI-generated media (images and videos) is clearly identified as such on the Platform.
  • You will not represent AI-generated content as being created by a real person.

Ownership of AI-generated media created through the Platform is shared: you receive a license to use it for personal, non-commercial purposes, and we retain the right to use it within the Platform's services.

5. Virtual Currency (Kinkoins)

5.1 Nature of Kinkoins

Kinkoins are a virtual currency used exclusively within the KinkSim platform. Kinkoins:

  • Have no real-world monetary value outside of KinkSim.
  • Cannot be exchanged for real currency, except through the creator payout program (Section 6).
  • Are non-transferable between accounts.
  • Are non-refundable once purchased, except as required by applicable law.

5.2 Purchases

Kinkoins can be purchased through the Platform using the available payment methods. All prices are displayed at the time of purchase. We reserve the right to change Kinkoin pricing at any time, but changes will not affect previously completed purchases.

5.3 Account Closure

If your account is terminated for violating these Terms, any remaining Kinkoins will be forfeited. If you voluntarily delete your account, unused Kinkoins are non-refundable unless required by applicable law.

6. Media & Monetization

6.1 Media You Send

When you generate and send media (images or videos) in conversations, you may set an unlock price in Kinkoins. Other users can unlock your media by paying the set price. When your media is unlocked:

  • You receive 80% of the unlock price as creator earnings.
  • The Platform retains 20% as a service fee.

6.2 Auto-Generated Media

The Platform may automatically generate and send locked media (images and videos) within conversations involving your character. This "auto-media" is created by AI using your character's profile and conversation context. For auto-generated media:

  • You receive 20% of the unlock price as a royalty.
  • The Platform retains 80%, as the Platform bears all generation costs and risk.

By creating a character on KinkSim, you consent to the Platform generating and monetizing auto-media using your character. Auto-media is designed to enhance engagement and provide you with passive income.

6.3 Creator Payouts

Creator earnings accumulate in your KinkSim wallet as Kinkoins. Payout terms, including minimum thresholds and payout methods, will be announced when the creator payout program launches. You are solely responsible for any taxes owed on your earnings in your jurisdiction.

7. Subscriptions

KinkSim offers optional subscription plans that provide additional features such as increased message limits, more character slots, and bonus Kinkoins. Subscriptions:

  • Are billed on a recurring monthly basis.
  • Can be cancelled at any time. Cancellation takes effect at the end of the current billing period.
  • Are non-refundable for the current billing period, except as required by applicable law.

We reserve the right to change subscription pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.

8. Prohibited Content & Conduct

You may not use KinkSim to:

  • Create, share, or solicit content depicting minors in any sexual or suggestive context. This is a zero-tolerance policy resulting in immediate and permanent account termination and reporting to relevant authorities.
  • Create characters based on real people without their explicit written consent.
  • Upload or distribute content you do not have the right to use.
  • Harass, threaten, stalk, or abuse other users.
  • Attempt to circumvent age verification, payment systems, or content restrictions.
  • Use bots, scripts, or automated tools to interact with the Platform without authorization.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
  • Use the Platform for any illegal purpose under the laws of Estonia, the European Union, or your local jurisdiction.

We reserve the right to remove any content and terminate any account that violates these rules, at our sole discretion and without prior notice.

9. Intellectual Property & DMCA

9.1 Platform IP

The KinkSim platform, including its design, code, AI systems, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our written permission.

9.2 Copyright Takedown (DMCA)

If you believe content on KinkSim infringes your copyright, you may submit a takedown request to our designated agent at legal@kinksim.com. Your request must include:

  • Identification of the copyrighted work.
  • Identification of the infringing content and its location on the Platform.
  • Your contact information.
  • A statement of good faith belief that the use is unauthorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

We will process valid takedown requests promptly and may remove the identified content. Users who receive a takedown notice may submit a counter-notice if they believe the removal was in error.

10. Privacy

Your use of KinkSim is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you consent to data practices described in the Privacy Policy.

11. Disclaimers

KinkSim is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. Specifically:

  • AI-generated content is provided without guarantees of accuracy, quality, or appropriateness.
  • We do not guarantee any level of earnings from the creator program.
  • We are not responsible for interactions between users, including any content exchanged in conversations.

12. Limitation of Liability

To the maximum extent permitted by applicable law, KinkSim and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Platform.

Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed the amount you paid to KinkSim in the 12 months preceding the claim, or €100, whichever is greater.

13. Termination

You may delete your account at any time. We may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination:

  • Your access to the Platform will cease immediately.
  • Any remaining Kinkoins will be forfeited, except as required by law.
  • Content you created may continue to exist on the Platform (e.g., messages sent to other users) but your profile and characters will be removed.
  • Earned but unpaid creator earnings will be handled according to the payout terms in effect at that time.

14. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved in the courts of Tallinn, Estonia.

If you are a consumer in the European Union, you may also be entitled to use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Platform or via email. Continued use of KinkSim after changes take effect constitutes your acceptance of the revised Terms.
